1. Acceptance of Terms

Welcome to ArtSign. By accessing or using our AI-powered artistic signature generation service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ArtSign ("we," "us," or "our").

2. Description of Service

ArtSign provides an AI-powered platform for generating artistic signatures using Google Gemini 2.5 Flash API. Our Service includes:

• AI-generated artistic signatures from text input
• 68 unique artistic styles and templates
• Multiple aspect ratios (1:1, 16:9, 3:2, 4:3)
• Cloud storage of generated signatures
• Credit-based generation system with subscription tiers
• Free tier with watermarks (2 signatures)
• Paid tiers without watermarks (Basic: 10, Pro: 30, Premium: 68)

3. Account Registration

3.1 Google OAuth Authentication

You must sign in using a valid Google account. By using Google OAuth:

• You agree to Google's Terms of Service and Privacy Policy
• You authorize us to access your basic profile information (name, email, profile picture)
• You confirm you are at least 13 years old
• You are responsible for maintaining the security of your Google account

3.2 Account Responsibilities

• One account per person
• You are responsible for all activities under your account
• Notify us immediately of unauthorized access
• Do not share your account credentials

• Prices are in USD and subject to change with 30 days notice

• Credits valid for 1 year from purchase date

4.3 Refund Policy

• Refunds available within 7 days of purchase if no credits used
• Partial refunds calculated based on unused credits
• No refunds for used credits or after 30 days

5. Usage Credits and Limits

• Each signature generation consumes 1 credit
• Credits are deducted upon successful generation
• Failed generations do not consume credits
• Credits expire 1 year after purchase
• No refunds for expired credits
• Credits are non-transferable between accounts

6. Acceptable Use Policy

6.1 Permitted Uses

• Personal artistic signatures for documents and branding
• Business signatures for professional use
• Creative design and artwork projects
• Educational and non-commercial purposes

6.2 Prohibited Uses

You agree NOT to:

• Generate signatures containing illegal, harmful, or offensive content
• Impersonate others or create fraudulent signatures
• Use the Service for spam, phishing, or malicious purposes
• Attempt to reverse-engineer or exploit the AI model
• Automate requests or abuse the API
• Resell or redistribute generated signatures commercially
• Upload names containing hate speech, profanity, or harassment
• Generate signatures for celebrities or public figures without permission

7. Intellectual Property Rights

7.1 Your Content

You retain all rights to the names and text inputs you provide. By submitting content, you grant us a limited license to process it through our AI service.

7.2 Generated Signatures

• You own the commercial rights to signatures you generate
• Free tier signatures include watermarks (cannot be removed)
• Paid tier signatures are watermark-free for commercial use
• You may use, modify, and reproduce generated signatures
• You may not claim AI-generated signatures as human-created artwork

7.3 Our Service

The ArtSign platform, including our website, software, templates, algorithms, and branding, is our exclusive property. You may not copy, modify, or distribute any part of our Service without written permission.

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Maintenance windows will be announced in advance when possible
• We reserve the right to modify or discontinue features
• Temporary service interruptions do not entitle refunds
• Credits remain valid during service outages

10. Data Privacy and Security

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

• Generated signatures are private by default
• We use industry-standard encryption (HTTPS/TLS)
• Third-party services (Google, Stripe) have their own privacy policies

11. Termination

11.1 By You

You may delete your account at any time from the Account Settings page. Upon deletion:

• Your personal data will be deleted within 30 days
• Unused credits will be forfeited (no refunds)
• Generated signatures will be permanently deleted

11.2 By Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your account remains inactive for 2+ years
• We must comply with legal obligations

12. Disclaimers and Limitations of Liability

12.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Generated signatures will meet your expectations
• AI outputs will be unique or free from defects
• Storage will be permanent or immune to data loss

13. Indemnification

You agree to indemnify and hold harmless ArtSign, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party rights.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, please contact us at support@artsign.cc to resolve the dispute informally. We aim to resolve disputes within 30 days.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14.3 Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law provisions.

15. Changes to Terms

We may update these Terms at any time. Changes will be effective immediately upon posting. We will notify you of material changes via:

• Email notification to your registered email address
• Prominent notice on our website
• In-app notification

Continued use of the Service after changes constitutes acceptance of the updated Terms.
